MINUTES

June 19, 2003

Memorial Hall, 3rd Floor, City Hall

Absent:  none

Approval of Minutes - The minutes of March 27, 2003 were unanimously accepted as written.

Draft Order of Conditions
§       136 Reservoir St. – Benjamin Dannaramma
The commission reviewed and voted 6-0 to approve the draft order of conditions with changes to condition #33 and 34 to reflect the new sequencing plan dated April 14, 2003, and to require the conservation officer be notified when dewatering is to be done.

§       127 Lakeside Ave. – Everest Construction
The commission reviewed the draft Order of Conditions and made several additions to require test borings prior to any work on the site and to meet with the conservation commission once this data is collected to determine if the plans need to be revised.  The Commission voted 7-0 to accept the Order as amended.

Notice of Intent
183 Lakeshore Dr. – Barry Landscape Co.
Jim Barry explained that he has been hired by the owners to remove an old timber retaining wall and replace it with a cement wall on a footing.  They will perform the work when the water level is low, either in August or during the next lake drawdown when the lake is about 2-3 feet lower.  They will likely need to dewater a bit for the footings, but are not anticipating needing a cofferdam.  The edge of the existing wall will be marked in the field prior to doing any removal and replacement work to ensure that the wall is in the same place.  Test pits will be done to determine the location of the water table prior to work.  If dewatering is necessary a sedimentation basin will be needed.  The Commission closed the hearing and will review a draft Order of Conditions at the next meeting on July 10, 2003.

Notice of Intent
Lot 3 Danjou Dr. – Crystal Ridge Realty Tr.
Robert Parente of Central Mass Engineering represented the applicant Fossile Construction.  The plan shows a substantial buffer zone around the vernal pool and bordering vegetated wetland.  The house is in the approximate location shown on the subdivision plans.  They have preserved the back of the lot by limiting cutting to the first 150 feet from the roadway.  The Commission discussed conditions to include a restriction on further cutting of this lot and marking this boundary, ongoing maintenance during construction of the erosion control barrier and the addition of a deck on the house.  The Commission closed the hearing and will review a draft Order of Conditions at the next meeting on July 10, 2003.

Lot 4 Danjou Dr. – Crystal Ridge Realty Tr.
Robert Parente of Central Mass Engineering represented the applicant Fossile Construction.  The plans showed erosion controls at least 30 feet from the wetland area, however one location is only 20 feet from the wetland.  A retaining wall is proposed along this boundary line.  The commission discussed the protection of the vernal pool, which is located on this property.  Greg Avisa an abutter requested that the trees along his lot boundary be preserved to provide some privacy between the new house and his house.  Mr. Fossile indicated that they would be able to leave a 30-foot wide area with vegetation.  After further discussion the commission closed the hearing, and will review a draft Order of Conditions at the next meeting on July 10, 2003.

20 Mosher Ln. – Doe Builders Inc.
Steve Poole of Consolidated Design presented a plan on behalf of the applicant Chris Mutti who was also present.  This lot contains the detention basin.  The rear of the lot will be planted with pines and bark mulch, the remainder will be loamed and seeded.  Prior to construction of the house the erosion controls will be reestablished in the field.  Access to the detention basin for maintenance is between the erosion controls and the wall.   Jeff Pecket of 33 Turner Ridge Rd., an abutter, asked if there would be any impact to the brook.  Mr. Poole indicated there would be none.  The Commission closed the hearing and will review a draft Order of Conditions at the next meeting on July 10, 2003.

Request for Determination of Applicability
11 Mosher Ln. – Doe Builders Inc.
Steve Poole of Consolidated Design presented a plan on behalf of the applicant Chris Mutti who was also present.  This is lot 1 near the entrance of the project.  Only a small portion of the lot is within the 100-foot buffer zone.  Haybales will be placed to control mud from washing into the roadway drainage system.  A drywell is proposed to infiltrate the roof runoff.  This area contains 8-10 feet deep sandy soil.  The Commission closed the hearing and voted 7-0 to issue a negative determination of applicability with conditions to have the erosion controls inspected before work begins.

At the applicant’s request this item was continued to the July 10, 2003 meeting.

Crane Meadow Rd. – Fairfield Green at Marlborough – FF Development LP
John Towhig of Goulston & Storrs, Brandon Quigley and Brian Sullivan of Rizzo Associates were present.  Brian Sullivan reviewed the June 17, 2003 response to the memo to Chairman Clancy.  A copy of the memo was placed in the file and all the items in the memo were reviewed and discussed.  The Commission determined that the phasing plan was appropriate but that prior to construction the site contractor will be required to come to the Commission to be sure they understand the sensitivity of the site.  The Commission discussed conditions for the drainage system and erosion controls.  The Commission requested that a draft Order of Conditions be prepared for the next meeting.  With the applicant’s consent the hearing was continued to the July 10, 2003 meeting.

Discussion  
§       Phragmites Control – DEP 212-888 – Donald Lynch Blvd. office park – Rosewood Construction  -  Michael and Paul Slazick of Rosewood Construction were present to provide an update on addressing the phragmites control at the above noted site.  They have identified several companies who can apply herbicides to the phragmites.  The treatment is expected to be done in early August.  They have a seed mix to use once the phragmites is eliminated.  The Commission requested that a final document be provided outlining the specific methods to be used.  This will be provided at the July 10, 2003 meeting.

§       Home Depot – DEP 212-771 – Storage in back of building
Ron Ramsey the current manager at the Home Depot site explained that they had been storing material outside in back of the building.  All the material is dated and will be moved into the building within a day or two of delivery.  The material is mostly lumber, however during the spring and summer months they do have racks with plants which are stored out in the rear parking area.  The Commission discussed some of the conditions and clarified Home Depot’s needs.  A letter will be drafted and reviewed at the July 10, 2003 meeting to explain what is allowable and what is not.  

§       Leash law issue – This item was continued to a later date.
§       JPI – DEP 212-677  Geoff Andrews of Wetlands Preservation Inc. and Kevin Malley of JPI were present as well as Paul Carney an abutter to the project living in Hudson.  Geoff Andrews reviewed a letter to the Commission dated June 13, 2003, which discussed the culvert issue on Brigham St. and the conversations they had with mosquito control to see if there was some historical dredging which could help restore some of the channels.  However, no historical dredging has occurred.   A letter was sent to all abutters to the culvert seeking construction access to allow them to replace the culvert.   (Copy in file)  Both culverts are working at half capacity.  The Commission discussed the condition of the culvert under Brigham St. and under the powerlines which both seem to be working below capacity.   Mr. Carney explained that JPI is asking permission to pass water through his property, which he does not think is permissible.  He requested that the members of the Commission and JPI and their representatives take a walk on the site to see the problems as they exist today.  Mr. Andrews indicated that the water has always passed through Mr. Carney’s land and that the reason water is backing up is because the culverts are not working properly under the power lines.   After some discussion the Commission agreed to set a site walk for June 25, 2003 at 5:00 PM, the Hudson Con. Com. will also be notified of the meeting.    

Extension Permits  
§       DEP 212-762 – Villages at Crane Meadow
Dave Franchi and Andy Iovanni were present and explained that this project is still under construction and needs at least a two year extension before it will be completed.  The Commission voted 7-0 to issue a two-year extension permit for this project.

Correspondence/New Business  
Signature for 18 LaRose Dr. -  The Commission voted to approve this at the last meeting, but signed the wrong form.  The correct form was signed.

The Commission reviewed the following items and voted to accept and place on file:
§       NSTAR Electric Gas – 5 year Vegetation Management Plan
§       DEP 212-895 386 South St. – Cappello – Letter from Oxbow Associates, Inc. dated May 28, 2003 RE: Buffer Zone Restoration Report.

Adjournment  
There being no further business the Commission voted to adjourn at 10:50 PM.
